Important Trash Notice Effective July 1, 2019

Virginia Run Residents:

 

Despite all of the Board and Management’s efforts to work with American Disposal Services (ADS) to resolve ongoing performance issues as well as to continue twice weekly trash pickups, ADS has informed the Association that due to the continuing driver shortage situation they can no longer accommodate twice a week trash service for single family communities.  ADS submitted a contract amendment to the Association that proposed to reduce trash pick-ups to one day a week in exchange for a modest monthly rate reduction ($1.65 per residence per month). The Board voted unanimously to reject the proposed amendment at the June Board of Trustees meeting.  We notified ADS of the Board’s decision and ADS still intends to reduce trash pickups to one day a week.  After discussing the situation with the Association’s counsel, we are compelled to comply with the new schedule until a new contractor is chosen in the fall. 

 

Beginning July 1, 2019, trash will no longer be picked up twice weekly.  Trash and yard waste will be picked up on Mondays and recycling only will be picked up on Thursdays.

 

While the Association is to receive a rate reduction through the end of the current contract period (December 31, 2019), the Board will likely not change the current trash assessment or provide a refund to Residents but rather will withhold the funds in favor of applying them to potential increases in the new contract that will begin on or before January 1, 2020.  The Board will decide on this matter at the July Board of Trustee’s meeting.  As a reminder, the Association dues include a direct pass through for the trash service.  By rule, any funds received from the reductions in trash services must be applied to the rate structure for the following year.
